6. General Principles
6.1 Which data do we collect from you and from whom do we receive this data?
We primarily process personal data that you provide to us or that we collect when operating our website. In some cases, we may also receive personal data about you from third parties. This may include the following categories:
- Personal master data (name, address, date of birth, etc.);
- Contact details (mobile number, email address, etc.);
- Financial data (e.g. bank account details);
- Online identifiers (e.g. cookie identifiers, IP addresses);

6.2 Under which conditions do we process your data?
We process your data in good faith and for the purposes set out in this privacy policy. We ensure that the processing is transparent and proportionate.
If, in exceptional cases, we are unable to comply with these principles, the processing may still be lawful if there is a valid justification, in particular:
- your consent;
- the performance of a contract or pre contractual measures;
- our legitimate interests, provided your interests do not override them.
6.3 How can you withdraw your consent?
If you have given us consent to process your personal data for specific purposes, we process your data within the scope of this consent unless another legal basis applies.
You may withdraw your consent at any time by sending an email to the address provided in the legal notice. Processing activities already carried out remain unaffected.
If you have subscribed to our newsletter, you can unsubscribe at any time by clicking the unsubscribe link included in the newsletter.
6.4 In which cases may we share your data with third parties?
a. Principle
In some cases, we rely on third party service providers or affiliated companies to process your data on our behalf (so called processors). Categories of recipients may include:
- Accounting, fiduciary and auditing companies;
- Consulting firms (legal, tax, etc.);
- IT service providers (web hosting, support, cloud services, website design, etc.);
- Payment service providers (only with your prior consent);
- Providers of tracking, conversion and advertising services (only with your prior consent).
We ensure that data is only disclosed with your explicit consent where this does not constitute commissioned data processing. We also ensure that these third parties and affiliated companies comply with data protection requirements and treat your personal data confidentially.
In certain circumstances, we may also be legally obliged to disclose your personal data to authorities.
b. Visiting our social media channels
Our website contains links to our social media channels. These are clearly identifiable, usually by corresponding icons. By clicking on these icons, you will be redirected to our social media channels.
The social media providers will then know that you accessed their platform from our website. They may use the collected data for their own purposes. Please note that we have no knowledge of the content of the transmitted data or how it is used by the operators.
c. Disclosure abroad
In the course of commissioned processing, your personal data may be transferred to companies abroad. These companies are obliged to protect your data to the same extent as we are. Transfers may take place worldwide.
If the level of data protection does not correspond to that of Switzerland, we carry out a prior risk assessment and contractually ensure that the same level of protection as in Switzerland is guaranteed, for example through the new standard contractual clauses of the European Commission or other legally required measures. If our risk assessment is negative, we implement additional technical measures to protect your data.
You can access the European Commission’s standard contractual clauses here:
https://commission.europa.eu/
6.5 How long do we retain your data?
We store personal data for as long as necessary to fulfil the purposes for which the data was collected and to maintain traceability of the customer relationship.
We retain contractual data for longer periods where required by law. In particular, we are required to retain business communications, concluded contracts and accounting records for up to 10 years.
6.6 How do we protect your data?
We store your data securely and take all reasonable measures to protect it from loss, access, misuse or alteration.
Our contractual partners and employees who have access to your data are obliged to comply with data protection regulations. In some cases, it may be necessary to forward your enquiries to affiliated companies. In these cases as well, your data will be treated confidentially.
Within our website, we use SSL encryption (Secure Socket Layer) together with the highest level of encryption supported by your browser.
6.7 What rights do you have?
a. Right of access
You may request information about the personal data we store about you at any time. Please send your request together with proof of identity to schweiz@profawo.ch
You also have the right to receive your data in a commonly used file format if we process your data automatically and if:
- you have given your consent for the processing of this data; or
- you have provided data in connection with the conclusion or performance of a contract.
We may restrict or refuse access to information or the release of data if this conflicts with our legal obligations, legitimate interests, public interests or the interests of a third party.
The processing of your request is subject to the statutory processing period of 30 days. However, we may extend this period due to a high volume of requests, legal or technical reasons, or because we require additional information from you. You will be informed of any extension in good time, at least in text form.
b. Deletion and correction
You may request the deletion or correction of your data at any time. We may reject the request if legal provisions require us to retain the data for a longer period or unchanged, or if another legal basis prevents deletion.
Please note that exercising your rights may conflict with contractual agreements and may have corresponding effects on the performance of the contract, such as early termination or costs.
c. Legal remedies
If you are affected by the processing of personal data, you have the right to enforce your rights through the courts or to file a complaint with the competent supervisory authority. The competent supervisory authority in Switzerland is the Federal Data Protection and Information Commissioner (FDPIC):
